Breach of contract
Like many others, Martinhal has withheld our 50% deposit (of almost 2000 Euros) in breach of contract. We are entitled to cancel our holiday free of charge up to 6 June. I have asked for cancellation and a refund numerous times this week and today they flatly refused. Vania of Martinhal’s Reservations Team emailed me to state that she understood my wish for a refund but stated that Martinhal is “unable to fulfil your wish”. I was informed that I would be given a credit towards a future holiday at Martinhal and that many others had accepted this. You will see from the reviews below mine that numerous other customers are in this situation. The hotel’s standard response to negative reviews on Trip Adviser is to say that it is not true to say that it is refusing refunds. However you will see from the paragraph above that this is entirely untrue. That is exactly what they are doing. I have had a refund flatly and expressly denied by email. I have the written record to prove this. I would therefore pay no attention to their responses to these reviews. I have pointed out to Martinhal that it is in breach of contract. I have directed them to their own terms and conditions. None of this has made any difference and I am now pursuing them via American Express. Put simply, Martinhal knows it is acting in breach of its own terms. No one can fail to feel sympathy for the tourist industry at this difficult time but, Martinhal, some of your customers are suffering financially too. I have taken unpaid leave to care for my two young children and cannot afford for you to take my money in the middle of an international pandemic. It is shameful behaviour and I am disgusted. You are not the only people suffering. To Martinhal’s Management my message is clear: Honour your legal obligations and think of someone other than yourselves at this difficult time. Your customers will not just let this drop or give up. We will collectively use the various legal channels available to us to reclaim what is rightfully ours. Your current strategy is eroding your reputation. It’s time for a rethink.
Terrible customer relations - deposit witheld - breach of contract!
We booked a two week family holiday at Martinhal (for July 2020) back in February with a 30 day cancellation policy. When we recently tried to cancel, we, like others have had our refund of our deposit refused. This is breach of contract and totally unacceptable. We understand your #postonedontcancel movement, and do not wish to see anyone suffer at this time, but you have shown total disregard for our own personal circumstances. We are unable to postpone or re-book and have a legal right to have our deposit refunded. This is particularly sad as this would have been our third trip to Martinhal and as returning guests we expected to see a much higher level of respect and understanding of customer's wishes and rights. We have very happy memories of Martinhal that are now tainted by this dreadful way of treating customers.
DO NOT STAY HERE!!! DISGRACEFUL BEHAVIOUR - WITHHOLDING REFUNDS
Like others here, I booked in March and under terms of full refund available for cancellations up to 30 days before travel. I now can't travel and Martinhal are refusing a refund in breach of the booking terms!!! They will only offer future credit, but I wont to ever set foot in the place based on this breach of trust. What a bunch of low life operators who put their business before refunding customers who need the cash in this precarious situation. Disgraceful behaviour and I would advise that people NEVER book here again. They have shown their true character and it is clear they don't care one bit about their customers.
DO NOT BOOK - deposits withheld
Like others here, I booked in February under terms of full refund available for cancellations up to 30 days before travel. I now can't travel and Martinhal are refusing a refund in breach of the booking terms. They will only offer future credit, although we can't travel the following year and don't want to ever set foot in the place based on this breach of trust.
Deposit withheld - breach of terms!
We booked this hotel as we had heard great reviews. We also made our choice on the basis that we could cancel and revive a refund 30 days prior to our holiday. We are due to go on holiday in August and the company is refusing to repay our deposit in a clear breach of its terms. Utter disgrace.
